Project manager narrowly avoids totting up ban

Appearing at Welshpool Magistrates Court on Tuesday, May 6, Daniel Peter Davies, of Codsall, Staffordshire, admitted driving without due care and attention, having previously admitted to driving without insurance.

At around 7 am on Monday, September 9 2024, Davies was driving along the A458 between Middletown and Trewern when his Ford Fiesta collided with a stationary van and a telegraph pole. Davies claimed that there was no signage to warn drivers of some temporary traffic lights that had been set up at the location of the accident. The prosecution contested this claim, and stated that Davies should have been aware of the dangers ahead and driven more slowly and with greater care.

A witness driving on the same stretch of road gave evidence in support of the prosecution’s case. Davies had stressed that driving was essential to his work as a project manager for a property firm, and that a driving ban would lead to considerable hardship.

Davies’ licence was endorsed with 7 penalty points, making a total of 10 points. The chair of the magistrates warned him to take great care to avoid further driving offences, as just 2 more penalty points would trigger a driving ban under the totting up system.
