Early removal of driving disqualification
Under the 1988 Road Traffic Offenders Act’s Section 42, a driver who has demonstrated rehabilitation, good character and genuine need to drive for care or work can apply to remove their disqualification after serving a part of the driving ban - for instance, if they have served two years of a four-year ban. Ultimately the court has discretion on the driving disqualification’s removal but will consider the offence, conduct and other circumstances with the potential to granting the ban being lifted at an earlier or later date. However, early removal of driving disqualification needs a formal application and is not guaranteed.
Who is eligible for early removal of a driving disqualification?
UK drivers are eligible for early removal of their driving disqualification under certain circumstances. Drivers must have served a specific minimum period to be able to apply for removal. For driving bans under four years, they must serve at least two years and for bands ranging from four to ten years, they must have served a minimum of four years. Finally, for bans greater than ten years, drivers must have served five years. It is worth noting that drivers applying for early removal of a driving disqualification must also provide a good reason or reasons why the court should consider lifting the ban - for instance, a legal error or change in circumstances.
How do you make an application for early removal of driving disqualification?
Motorists serving a driving ban can apply to have a driving disqualification removed by writing to the specific Magistrates' Court that has imposed the ban. In the application, drivers should explain why they need their licence to drive back, supported by strong evidence. Common reasons are because of personal hardship or for work.
After applying, drivers attend a hearing at the Magistrates' Court, where a decision is made based on the driver’s reasons and personal conduct.
