Will I get fixed penalty due to my vehicle being overweight?
VOSA will normally impose a fixed penalty for a first relatively minor
5-10% overloaded – £60 10-15% overloaded £120
15-30% overloaded £200
More than 30% overload will result in court proceedings and the penalty
increases to a level 5 fine which is unlimited.
If my vehicle is overweight is there any other offence I could be charged with?
The maximum penalty that could be imposed under this section is a level 5 fine which is unlimited, a disqualification from driving and 3 points if no disqualification is imposed.
Could I be disqualified?
However, if you can prove that you did not know or had no reasonable cause to suspect that the use of the vehicle involved a danger of injury to any person you may avoid a disqualification.
This may be difficult to establish particularly if an accident has been caused.
